Wag! Gift Cards
Wag! Gift Cards (“Gift Cards”) are issued by Wag Labs, Inc. d/b/a Wag!. The Gift Card may be redeemed for credit towards the purchase of services available through the Wag! platform. Gift Cards do not expire, and no fees are associated with their maintenance or use. Gift Cards may not be sold, copied, modified, transferred, reloaded, returned, or redeemed for cash, except to the extent required by law. Purchase and use of the Gift Cards are subject to these Gift Card Terms and Conditions, the Wag! Terms of Service, and the Wag! Privacy Policy (collectively, the “Terms”).
Use. Gift Cards may be redeemed only toward the purchase of eligible pet care services provided through the Wag! platform (the “Services”). Funds or credits from Gift Cards cannot be used for tips. All Services are not available in all locations. Once a Gift Card has been added to a redeemer’s account, the funds on it will not expire. The redeemer must have a secondary payment method on their account to use the Gift Card. Gift Card balances will be automatically applied when Services are booked. Any unused Gift Card balance will remain in the redeemer’s Wag! account in the form of a credit. If Services purchased exceed a redeemer’s Gift Card balance, then the redeemer must pay the difference, using another payment method associated with the redeemer’s account.
Limitations. Gift Cards can be redeemed only with a registered Wag! account in good standing. Unused Gift Card balances may not be transferred from the redeemer’s account to another account. Gift Cards cannot be sold, copied, modified, transferred, reloaded, resold, returned, transferred for value, or redeemed for cash, except to the extent required by law. Wag! is not a retailer or seller and does not provide pet care services.
Account Corrections. Wag! reserves the right to correct any Gift Card balance in a Wag! account at any time in the event of a clerical, accounting, or similar error.
Risk of Loss. The risk of loss and title for a Gift Card passes to the purchaser after Wag! transmits the Gift Card redemption code to the purchaser or designated recipient. Once issued, Wag! is not responsible for the loss, theft, destruction, or unauthorized use of any Gift Card.
Fraud. In the event of suspected fraud, unlawful activity, or violation of the Terms, Wag! reserves the right to refuse to issue or honor a Gift Card, deactivate, cancel, or suspend any Gift Card credit, bill alternative forms of payment, close customer accounts, or to terminate any other rights or obligations under the Terms.
Limitation of Liability. WAG! IS NOT LIABLE TO ANYONE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES OF ANY TYPE OR KIND IN ANY WAY CONNECTED WITH GIFT CARDS. WAG! IS NOT LIABLE FOR ANY LOSS, DAMAGE, OR INJURY THAT MAY BE INCURRED BY YOU IN ANY WAY CONNECTED WITH GIFT CARDS, EVEN IF WAG! HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WAG! MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU.
Arbitration. Any dispute or claim relating in any way to Gift Cards or these Terms and Conditions will be resolved in accordance with the Arbitration Agreement section of Wag!’s Terms of Service. Please review the Wag! Terms of Service carefully to understand how disputes will be resolved and your right to opt out.
Other Terms. The Terms, and your use or redemption of a Wag! Gift Card, are governed by the laws of the State of California without regard to choice of law and conflict of law principles. Wag! reserves the right to change the Terms from time to time in its discretion, with any such changes to be effective when publicly posted.
